The paperwork is sitting on your kitchen counter. A citation, a piece of paper the officer called a temporary permit, and a court date printed in small type. You are sober now, and the question that will not leave you alone is what actually happens from here.
Here is the honest sequence of a DUI case in Paulding County, from the night of the arrest through the day the case ends.
Two Separate Cases Start the Moment You Are Arrested
This is the part almost nobody knows, and it matters more than anything else on this page. A DUI arrest in Paulding County sets two independent processes in motion at the same time.
The criminal case proceeds through the Paulding County court system. It moves at the pace of a court calendar, which usually means weeks or months. You are presumed innocent throughout.
The administrative license case proceeds through the Georgia Department of Driver Services and has nothing to do with guilt or innocence. It is triggered by either your test result or your refusal to test, and it runs on its own deadline.
People focus on the criminal case because that is where the court date is. Then they lose their license to a process they did not know was running. Both cases need attention, and the administrative one needs it first.
Booking and Getting Out
After the arrest, you will be transported to the Paulding County Jail at 190 Constitution Boulevard in Dallas, behind the courthouse on the Watson Government Complex. Booking takes a few hours.
For a standard first DUI, release usually comes relatively quickly through a bond, and many people are out the same day or the next morning. Bond can be posted in cash or through a bail bondsman. If there were aggravating circumstances, such as an accident or additional charges, a first appearance before a magistrate may be required before bond is set.
The 30 Day Deadline That Decides Your License
Within 30 days of being served with notice of an administrative license suspension, you or your attorney must take one of two actions:
- Request an administrative license suspension hearing to contest the suspension, which can extend your temporary driving privileges until the hearing, or
- Install an ignition interlock device and obtain the permit that goes with it under O.C.G.A. § 40-5-64.1
If neither happens within 30 days, the suspension takes effect automatically. There is no grace period and no way to reopen it later. The suspension length depends on the specific facts of the case.
This is the most common irreversible mistake people make after a DUI arrest, and it happens because the deadline is nowhere near as visible as the court date.
Your First Court Date
Misdemeanor DUI cases in Paulding County are heard in Paulding County State Court, located at 280 Constitution Boulevard in Dallas. The court currently has two judges, and your case will be assigned to one of them.
Your first appearance is the arraignment, where the charges are formally read, and you enter a plea. Do not expect the case to be resolved that day. Arraignment is a procedural step, not a trial.
What you should expect at arraignment:
- The charges against you read into the record
- An opportunity to enter a plea of not guilty, which preserves all of your options
- Scheduling for the next stage of the case
- Confirmation of any conditions of bond you must continue to follow
If you have a lawyer, your attorney may be able to handle certain appearances on your behalf and will file the discovery requests that get the state’s evidence into your hands.
The Middle of the Case
Between arraignment and resolution is where the actual defense work happens, and where most DUI cases are won or improved.
Discovery. Your attorney requests the arrest report, dashcam and body camera video, the breath testing instrument’s calibration and maintenance records, the implied consent documentation, and any blood or urine testing records.
Reviewing the stop. An officer needs a lawful reason to pull you over. If the stop was not supported by reasonable suspicion, everything found afterward may be subject to suppression.
Reviewing the testing. Field sobriety tests must follow standardized procedures. Breath testing requires a proper observation period and a properly maintained instrument. Implied consent notices must be read correctly and at the right time. Each of these is a potential point of failure in the state’s case.
Pre-trial motions. Where problems exist, your attorney files motions to suppress. A granted motion can gut the prosecution’s evidence and change the negotiating posture entirely.
Negotiation. With the weaknesses identified, your attorney discusses resolution with the prosecutor.
What a Conviction Actually Carries
A first DUI in Georgia is a misdemeanor under O.C.G.A. § 40-6-391, and the sentence typically includes:
- Up to 12 months in jail, with a portion often served on probation
- Fines from $300 to $1,000, plus surcharges
- License suspension, with limited permit eligibility on a first offense
- 40 hours of community service
- DUI school, formally a Risk Reduction Program
- A clinical evaluation and any recommended treatment
- 12 months of probation in most cases
Beyond the sentence, expect a substantial insurance increase and a conviction that stays on your Georgia driving record permanently. Georgia does not allow DUI convictions to be restricted.
How Paulding County DUI Can Be Resolved
Reduction to reckless driving. Reckless driving is not automatically a lesser offense of DUI in Georgia, so this requires the prosecutor’s agreement. It usually happens when the defense has identified real problems with the evidence. A reduction avoids the automatic license suspension and does not count as a prior DUI later.
Dismissal. When a suppression motion succeeds or the evidence is fundamentally weak, charges can be dropped. This is the gold medal for DUI defense.
DUI Court. Paulding County State Court operates a DUI Court program. For eligible defendants, particularly repeat offenders, this structured treatment and supervision track can substantially change the sentencing outcome.
Plea to DUI. Sometimes the evidence holds and the goal shifts to minimizing the sentence.
Trial. When the state cannot prove its case, trial is the right answer.
What to Do This Week
- Handle the 30 day license issue. Nothing else on your list is more time-sensitive.
- Write down everything you remember about the stop, the tests, and the arrest while it is fresh.
- Do not discuss the case on recorded jail calls or on social media.
- Keep every document, including the temporary permit and citation.
- Talk to a defense attorney before your arraignment, not after.
