Common Reasons for License Suspension in Georgia

The Georgia Department of Driver Services (DDS) can suspend your license for all kinds of reasons, and many of them catch drivers by surprise. Here are some of the most common:

1. Super Speeder Offenses

If you’re convicted of driving:

  • 75+ mph on a two-lane road, or
  • 85+ mph on any road,

You’ll be labeled a “Super Speeder” and owe a $200 fee to DDS. If you don’t pay it within 120 days, your license is automatically suspended—even if the court process is over.

2. Child Support Noncompliance

Missed child support payments? DDS receives notices directly from the Department of Human Services (DHS). If you fall behind, your license can be suspended until you catch up—no exceptions.

3. DUI Convictions

Even a first-time DUI conviction in Georgia can lead to a license suspension. That includes out-of-state DUIs, and this suspension is different from administrative license suspensions triggered by refusing a breathalyzer.

4. Failure to Appear (FTA)

Did you miss a court date or forget to pay a traffic ticket? That’s an automatic FTA suspension—and it stays in place until the underlying court case is resolved and reinstatement steps are taken.

5. No Proof of Insurance

Georgia law requires all registered vehicles to have active liability insurance. If you can’t show proof of insurance during a traffic stop, your license can be suspended—even if your car was insured and you just didn’t have the card.

6. Points Accumulation

If you rack up 15 or more points in 24 months, your license will be suspended. For drivers under 21 or under 18, the threshold is even lower:

  • 4 points in 12 months for drivers under 18
  • Any single 4-point offense for drivers under 21 (like reckless driving or aggressive driving)

Can You Drive with a Suspended License in Georgia?

Only in limited cases. Georgia offers a Limited Driving Permit for some suspension types—typically for first offenses or administrative suspensions.

These permits restrict your driving to:

  • Work or school
  • Medical appointments
  • Attending College or School
  • Attending treatment support organization meetings (Like Alchoholics Anonymous)
  • DUI education programs
  • Court appearances or meeting with probation officers
  • Taking a dependent to necessary services like work, medical care, or school

Driving outside those restrictions is illegal and may lead to arrest, jail time, and additional suspensions. Remember, you MUST have the limited permit to enjoy this limited ability to drive. You cannot drive to these places if your license is suspended and you have no permit.

Penalties for Driving on a Suspended License

If you’re caught driving after your license has been suspended or revoked, the penalties are steep:

First Offense:

  • Misdemeanor charge
  • Sentence Range: 2 days to 12 months
  • Minimum $500 fine
  • Additional suspension
  • Possible probation

Second Offense or Third (within 5 years):

  • High and aggravated misdemeanor
  • Sentencing Range: 10 days to 12 months
  • Minimum $1,000 fine
  • Possible felony classification

Fourth Offense Or more

  • Felony Conviction
  • Sentencing Range: 1 year – five years
  • Minimum $2,500 fine

The court doesn’t take these lightly—especially if you’ve been warned before. That’s why having an attorney involved from the beginning can make all the difference.

How We Help With Suspended License Cases

At J. Ryan Brown Law, we don’t just tell you what went wrong—we help you fix it.

Here’s how we handle license suspension cases:

Step 1: Investigate the Source of Suspension

We check the DDS record, track down the originating court or agency, and verify whether the suspension is active, expired, or in error. Many drivers don’t even know exactly what triggered their suspension.

Step 2: Challenge the Underlying Offense

Sometimes the suspension stems from a conviction that should’ve been resolved—like:

  • A ticket you already paid
  • A court date you weren’t notified of
  • A child support mistake
  • An insurance lapse that wasn’t your fault

We contact courts, DMV officials, and licensing agencies to correct outdated or inaccurate records.

Step 3: Negotiate Reinstatement Requirements

Once we understand what’s holding your license hostage, we’ll help you:

  • Apply for a limited driving permit, if eligible
  • Handle Super Speeder or reinstatement fees
  • Resolve FTAs
  • Clear up unpaid fines
  • Get necessary courses or evaluations scheduled

Many reinstatement requirements are confusing or buried in DDS records—we walk you through every step.

Step 4: Fight New Criminal Charges

If you’ve already been cited or arrested for driving on a suspended license, we go to court with you. We’ll work to:

  • Get the charges reduced or dismissed
  • Avoid jail time
  • Prevent a criminal conviction
  • Protect your license going forward

Multiple Suspensions? We Handle That, Too.

Some drivers face stacked suspensions—Super Speeder, DUI, points, and FTA all wrapped into one. If you’re overwhelmed by letters from DDS, court notices, or old tickets, we’ll help you:

  • Prioritize what needs fixing first
  • Understand which suspensions run concurrently and which are consecutive
  • Create a clear, customized plan for reinstatement
  • Get you back on the road legally and permanently

Why You Shouldn’t Wait

The longer you delay, the harder reinstatement becomes. Here’s why:

  • Points stay active
  • Court fines accrue late fees
  • DDS sends cases to collections
  • Driving without a valid license exposes you to arrest

If your license is suspended, you’re already under the microscope. The sooner we start working on a solution, the better your chances of avoiding criminal charges, jail time, or long-term consequences.
