A Failure to Appear occurs when a person who has been cited or charged fails to attend their scheduled court hearing or fails to respond to a citation, such as by paying a fine or entering a plea.

Under O.C.G.A. § 40-13-62, if you miss your court date for a traffic citation:

  • The traffic court loses jurisdiction over your case;
  • Your citation is forwarded to the prosecuting attorney;
  • An accusation is filed against you;
  • A bench warrant is issued for your arrest.

Under O.C.G.A. § 40-13-63, this failure to appear is a separate criminal offense, punishable by:

  • A fine up to $200, or
  • Up to three days in jail.

If the offense involves a traffic violation, your driver’s license may also be suspended by the Georgia Department of Driver Services (DDS).

FTA and Driver’s License Suspensions: How It Works

A Failure to Appear doesn’t just affect your criminal record—it directly impacts your driving privileges. Here’s how the DDS processes an FTA:

1. Court Notifies DDS

The court electronically reports the FTA to DDS. DDS then schedules your license for suspension.

2. 28-Day Window

You have 28 calendar days from when DDS receives the FTA notice to resolve the citation with the court before your license is suspended.

3. License Suspension

If you don’t resolve the matter, DDS suspends your license. You will receive a suspension notice and will not be able to legally drive.

4. Reinstatement

Your driving privileges are not reinstated automatically just because you pay the ticket. You must:

  • Get a release from the court;
  • Pay a $100 DDS reinstatement fee;
  • Confirm the release has been electronically submitted to DDS.

Once these steps are complete, your license will be reinstated.

FTA for Out-of-State Citations

If your FTA originated in another state but is reported to Georgia:

  • If the citation is resolved before your suspension date, no fee is due to DDS.
  • If it’s resolved after suspension, you must pay applicable reinstatement fees.

Don’t assume an out-of-state ticket will go away on its own. Many states share driving records, and Georgia will act on out-of-state FTA reports.
